The Kentucky Department of Insurance issued a bulletin announcing a commercial market dispensing fee requirement of $16.31, effective Jan. 1, 2027. In 2024, legislation was passed that established a reimbursement floor in the commercial market of NADAC plus a $10.64 dispensing fee, with a requirement that the department analyze data collected by the Board of Pharmacy. The Board of Pharmacy’s first-of-its-kind commercial market analysis was built upon the Kentucky-specific results from a national cost to dispense survey jointly produced by NCPA, NACDS, and NASP in 2020.
Per the 2024 law (SB 188), the reimbursement applies to all Kentucky pharmacy locations, excluding mail-order only pharmacies and distributors. The bulletin details its enforcement policy and expectations for compliance. The bulletin can be found here.
