The bill is coming to the floor for a vote in both chambers of Congress (later this week in the House and next week in the Senate). The bill includes provisions that would:

Require CMS to define reasonable and relevant contract terms, including those related to reimbursements, in the Part D program.

Establish a mechanism for pharmacies to report contract violations.

Introduce a designation for “essential retail pharmacies” which will allow CMS to track payment trends to pharmacies deemed essential and their inclusion in PBM networks.

Give CMS the tools and resources to enforce contact standards.
