What: NCPA Panel of Experts for State Action

Why: NCPA has assembled a diverse array of experts in different areas to assist states, based on certain criteria, in their legislative and regulatory initiatives.

How: State associations will fill out a form requesting assistance from a specified expert and/or specified area of expertise.

Areas of Expertise

ERISA/understanding health plan benefit design 

Educate policymakers about existing state law regarding ERISA and the extent to which active legislation and regulatory oversight/enforcement pertain to plans. Additionally, provide education on how PBMs and brokers function with health plans.

Medicaid agencies

Provide consultation and assistance regarding (and not limited to):

  • Cost of dispensing surveys 

  • State plan amendments and engagement with the Centers for Medicare & Medicaid Services

  • NADAC benchmark inner workings

Offices of the Insurance Commissioner, PBM regulation enforcement

Provide guidance, testimony, and other information to state departments of insurance and state legislatures on best practices for implementing and enforcing PBM regulations.

General drug supply chain, drug pricing and pharmacy operations knowledge

Provide guidance, testimony, and other information to state legislatures and other state policymakers to provide a bigger picture of drug pricing along the supply chain, primarily to legislative audiences such as bill hearings and working groups.

Communications strategy and grassroots support

Provide direct grassroots advocacy within the state by NCPA’s grassroots team. Grassroots would be targeted for specific asks of state policymakers. NCPA communications team can provide guidance on best communications strategies for local/state advocacy campaigns.
