NCPA submitted comments to a draft guidance from CMS on the Medicare Drug Price Negotiation Program and the manufacturer effectuation of the Maximum Fair Price (MFP) in 2028. NCPA reiterated concerns it has previously raised, including that manufacturers should reimburse authorized generics at the Standard Default Refund Amount (wholesale acquisition cost minus the MFP), or an otherwise transparent amount.
We also stated that manufacturers should provide more support to pharmacies with material cashflow concerns, and that CMS needs to swiftly develop a permanent solution to the issues causing inappropriate rejections of pharmacies’ MFP refund claims due to the assumption that the drugs are 340B drugs and that the pharmacy is a contract pharmacy.
