Back our push to ban PBM ownership of pharmacies nationwide

NCPA May 28, 2026

We’re on the cusp of perhaps one of the biggest, most important PBM reforms in our nation’s history.

Recently, the FAIR Rx Act was signed into law in Tennessee, which would officially ban PBMs from owning pharmacies in the state. PBM reform champions Reps. Diana Harshbarger (R-Tenn.) and Jake Auchincloss (D-Mass.) also introduced a similar bill in the U.S. House of Representatives. Sens. Josh Hawley (R-Mo.) and Elizabeth Warren (D-Mass.) then introduced a version to the Senate.

This bill would deal a huge blow to PBMs like CVS by breaking up their monopolies and stopping them from rigging the game against you through their anticompetitive activities. This legislation would prohibit PBMs from owning pharmacies in this country. Period.

With the stakes this high, the NCPA Government Affairs team is not letting up. We continue to pound the halls of Congress urging members to get this important piece of legislation passed.

But it’s not going to be easy. The only chance we have at putting up a fight is with your help and the help of the thousands of independent community pharmacy owners across the country.

If you’re able to help us in this fight, please consider investing anything you can afford – $50, $150, $250 or more – to the NCPA Legislative/Legal Defense Fund today.
