Pharmacy bills to be marked up in House committees today

NCPA May 21, 2026

Two major pharmacy-related bills will receive committee markups today, a sign of Congress’ continued attention to pharmacy access, one on PBM kickbacks and the other on test and treat services in pharmacies.

H.R. 7895, the “PBM Kickback Prohibition Act,” would prohibit PBMs from paying referral fees or kickbacks to an intermediary (like a broker) in exchange for directing an insurer or employer health plan to the PBM. Introduced in March of this year by Rep. Rick Allen (R-Ga.), this bill represents a bold step in reining in PBM influence over the healthcare system and bringing down costs for employers and patients. The House Committee on Education and the Workforce will mark it up along with four other bills this morning at 10:15 a.m. ET – watch that markup live, here.

H.R. 3164, the “Main Street Pharmacy Access Act” (formerly known as the “Ensuring Community Access to Pharmacist Services Act”), would ensure Medicare beneficiaries can easily access health care services by authorizing pharmacists to test and treat COVID-19, flu, respiratory syncytial virus, and strep throat. It was reintroduced in May 2025, having been previously introduced in past Congresses. Reps. Adrian Smith (R-Neb.) and Brad Schneider (D-Ill.) are the two primary sponsors, and the bill currently has 112 bipartisan cosponsors as well as a Senate companion (S. 2426). The House Committee on Ways and Means will hold a markup alongside eight other bills this morning at 9 a.m. ET – you can watch that markup live, here.

NCPA will be watching both markups closely, and we will be communicating with members once they are reported out of their respective committee.
