Expansive reimbursement legislation on the move in New Jersey

Legislation has cleared the New Jersey General Assembly, the lower chamber of the state legislature, that would require a reimbursement floor of NADAC plus the Medicaid professional dispensing fee of $10.92 in the commercial market, state employee and school employee health plans, and the Medicaid managed care program.

The vote came quickly on the heels of a successful Assembly Appropriations Committee hearing, which featured testimony from NCPA members Brian Pinto of Tiffany Natural Pharmacy and Anthony Reznik of the Independent Pharmacy Alliance. NCPA provided written testimony to the hearing as well.

In addition to the expansive reimbursement floor provisions, A. 1502 assigns fiduciary responsibility to PBMs, prohibits PBMs from reimbursing their owned or affiliated pharmacies more than those not owned or affiliated with a PBM, and delinks PBM compensation from drug rebates. The bill is now in the Senate, where it was referred to the Commerce Committee.
