We have been informed that NCPA member pharmacies have been solicited by attorneys regarding a potential class action against GoodRx regarding its "Integrated Savings Program," or ISP.
NCPA member pharmacies are included in these ISP lawsuits as "absent class members" and will remain in the class unless they specifically choose to opt out at a later point in time. If you don't opt out, you remain part of the class action and can share in the benefits of the lawsuit if it is successful. As a result, at this time, you do not need to do anything to protect your rights if you do not want to do so.
NCPA has been involved in this litigation against GoodRx and various PBMs since Jan. 22, 2025, joining pharmacies who are pursuing class action claims on behalf of independent pharmacies nationwide who are also seeking damages.
We are happy to report that as a result of our litigation, GoodRx is no longer operating its ISP. However, damages still resulted from that program, which is why NCPA and other litigants will continue their class action against GoodRx.
If you have further questions or wish to discuss this matter in greater detail, please do not hesitate to contact attorneys in this class action: Natasha Fernandez-Silber, Edelson PC at [email protected]; and Halley Josephs, Susman Godfrey LLP at [email protected].
