Senators reintroduce key PBM reform policies

Last week, Sens. Marsha Blackburn (R-Tenn.), Maggie Hassan (D-N.H.), James Lankford (R-Okla.), and Mark Warner (D-Va.) introduced the Patients Before Middlemen (PBM) Act. This legislation reintroduced some of the policies NCPA championed last year, including implementing true any willing pharmacy provisions and requiring reasonable and relevant pharmacy contract terms in Medicare Part D, as well as delinking the PBMs' compensation from the listed drug price and instead moving to a flat service fee.

These policies were agreed to and included in the negotiations at the end of last year and would stop PBMs from exploiting loopholes that allow them to drive up prices and ensure pharmacies are given fair and equitable treatment. NCPA is grateful for the introduction of these key policy priorities in the 119th Congress, and the senators' commitment to continuing the fight on PBM reform.
