Last week, NCPA joined a class action lawsuit against the discount drug card company GoodRx, CVS Caremark; Express Scripts, Inc.; MedImpact Healthcare Systems, Inc.; and Navitus Health Solutions, LLC. The lawsuit, brought by Michigan independent pharmacy Community Care Rx, alleges the companies collude in a price-fixing scheme for reimbursements to independent pharmacies by not competing with each other on discount card transactions in violation of federal antitrust law.
"GoodRx's business model already potentially misleads consumers by preferentially listing some large chain pharmacies in their search results despite the higher-ranked pharmacies having higher prices, excluding nearly all independent pharmacies from appearing in the results," said NCPA CEO Douglas Hoey. "The actions alleged in this class action suit further disadvantage small businesses and cater to PBMs."
With this being a class action lawsuit, there's nothing NCPA members need to do at this time. We'll keep you informed on the case as it moves through the legal process.
