Tell your senators to push leadership on PBM reform

NCPA December 11, 2024

Over a thousand letters have been sent so far to Senate offices asking them to sign a letter urging leadership to help pass PBM reform before the end of the legislative session. Please take a moment to contact your senators and ask them to get on board with this crucial reform. Today's the last day to reach out and encourage them to sign on, so act now!

The bipartisan letter, spearheaded by Sens. James Lankford (R-Okla.) and Mark Warner (D-Va.), urges the chamber's leadership to finalize the PBM provisions that have moved through the Senate Finance and Senate HELP committees with overwhelming bipartisan support in a year-end legislative package.

These provisions include:

  • Improved pharmacy payments in Medicaid managed care programs by requiring a national standard for PBMs to reimburse NADAC plus the state's fee-for-service dispensing fee for all Medicaid managed care prescriptions. This provision would improve pharmacy reimbursements in over 30 states that have Medicaid managed care, as well as enshrine protection for the few states that have already acted.

  • Requiring CMS to establish reasonable and relevant Medicare Part D PBM contract terms, including pharmacy reimbursements, and create a role where pharmacies can dispute PBM contracts allowing CMS to then impose penalties on PBMs.
