Two resolutions were read and adopted by the House of Delegates on Tuesday at its annual meeting. Resolution number one ratified the actions of the Board over the past year since the 2022 annual meeting in Kansas City. Number two resolved that no PBM shall amend an agreement, provider manual, or other contractual term or document by fax and shall send a minimum of three electronic alerts to the pharmacy owner, or pharmacists in charge on record with the PBM, a minimum of 30 days before any contractual terms go into effect.
Number two also resolved that any PBM contracts, amendments or changes to terms should be opt-in (rather than opt-out), require a verification of receipt and pharmacy provider signature of acceptance, and the full provider notification/option period should precede beneficiary notification by a minimum of 15 business days. Additionally, PBM notifications to beneficiaries shall be required to include updated provider network records that take into account pharmacy provider opt-ins from the pharmacy notice period.
Finally, it was resolved that PBMs shall make available to a pharmacy provider each and every contract, amendment, provider manual, or like document to which pharmacy provider is a party through a website in a downloadable format.

At the 2023 meeting of the House of Delegates, NCPA's newest vice president, Ashley Moose, owner and pharmacy manager of Moose Pharmacy, delivered impassioned remarks about pharmacy's future and the opportunities ahead.
"Throughout this conference, I recall numerous remarks on how far we have to go yet to be successful in exposing PBMs for their unfair practices. I can't help but draw a comparison between the challenges we face and the challenges of a long-term journey," she said. "I've learned so many lessons from running on how to prepare for all conditions. Sometimes the hardest miles of a marathon are between miles 16 and 26—we're overwhelmed by what's ahead and we forget what we've overcome. But that's when we have to keep grinding and keep fighting."
