The New York State Department of Financial Services is proposing wide-ranging rules to regulate PBMs, opening a public comment period through Oct. 16. Most notably, the proposal includes a reimbursement floor applicable to the commercial market of NADAC plus a dispensing fee of $10.18, the state’s CMS-approved Medicaid dispensing fee. The proposal also addresses NCPA priority issues such as patient steering, reimbursement parity with PBM-owned or affiliated pharmacies, options for transparent pricing, audit protections, and network access.
