Senate reintroduces bill to broaden FTC enforcement powers against PBMs

NCPA strongly supports the recent reintroduction of two bills: S. 527, the Pharmacy Benefit Manager Transparency Act, which expands the Federal Trade Commission's enforcement authority against pharmacy benefits managers; and S. 526, the Prescription Pricing for the People Act, which adds transparency to congressional efforts to address high drug costs and patient access issues. Both bills made it through committee markup in the 118th Congress.

S. 527, sponsored by Sens. Maria Cantwell (D-Wash.), Chuck Grassley (R-Iowa), and nine of their colleagues, would give the Federal Trade Commission and state attorneys general the ability to penalize or initiate legal action against pharmacy benefit managers for certain unfair or deceptive business practices in the commercial space. S. 526, also led by Grassley and Cantwell, as well as 10 other original cosponsors, would bring more transparency into health care and support Congress as it crafts evidence-based solutions to address high drug costs and patient challenges in accessing needed health care services from the pharmacy of their choice.
