The NCPA National Legislation Committee and the NCPA State Government Affairs Committee meet separately today to discuss recent legislative events and to come up with a legislative action plan for 2024. This has been a transformative year already for pharmacy with actions at the state level and the federal level that point the way to a bright future. This past June, the Senate heard about the NCPA-backed legislation called Protect Patient Access to Pharmacies Act. In July, the FTC walked back its previous statements that protected PBMs, leaving the middlemen with barely a fig leaf to hide behind. And before it went on summer break, the Senate Finance Committee advanced the Modernizing and Ensuring PBM Accountability Act to the full Senate by a 26-1 vote. This package contained several NCPA priorities including a cost-plus reimbursement floor in all state Medicaid managed care programs and standardized quality metrics and mandated claim-level reporting for all Medicare Part D plans. Less than six weeks ago, members around the country participated in NCPA’s Month of Action by inviting legislators to their home turf — their pharmacies — to talk about PBM reform, reimbursements, the challenges of staying independent, and what 2024 will hold.
