NCPA informs new merger guidelines in joint DOJ and FTC meeting

Last month, the Department of Justice and the Federal Trade Commission released draft guidelines to address the ways in which mergers can weaken competition in the modern economy — harming consumers, workers, and small businesses. As part of the rollout, NCPA’s General Counsel, Matt Seiler, participated in “Breaking Down the New Merger Guidelines,” a conversation between Assistant Attorney General Jonathan Kanter and FTC Chair Lina Khan, held in partnership with the American Economic Liberties Project, NCPA, and other organizations. The Aug. 10 event covered how small business owners, workers, and entrepreneurs should view the new guidelines, what they will mean for the future of the economy, and how they will revitalize antitrust law. “Like the technology space, retail pharmacies suffer from bad actors creating closed-loop or walled gardens where the dominant actors established a market and controlled access to the market through rules and fees that disadvantage competitors,” said Seiler in his Aug. 10 comments, which you can watch here. “Our members welcome merger guidelines that consider the effect on competition and not only speculative price reductions.”
