burn baby burnIs it a HIPAA violation to ask someone if they’re vaccinated?
For the average person, it’s not a HIPAA violation to ask, but there’s no real obligation to answer either. If, however, you are an employer or HIPAA-covered entity (such as a pharmacy), you need to be careful what you do with the answer. Employers should review guidance published by the U.S. EEOC on workers who are unvaccinated due to a disability or sincerely held religious practice or belief. Remind pharmacy employees involved in administering vaccines that vaccination status is protected health information and about inappropriate disclosure of vaccination status. For example, a pharmacy may not disclose a patient’s vaccination status to the patient’s employer without written permission.
